Terms of Service
Effective date: October 8, 2026
These Terms of Service (“Terms”) govern your access to and use of Æther at aethertrading.app, including our options-market positioning analytics, exposure maps, flow tape, alerts, model-driven setups, paper-trading track record, educational content, AI assistant, and related services (collectively, the “Service”). The Service is provided by Aether, a sole proprietorship based in California, USA (“Aether,” “we,” “us,” or “our”).
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent that you are at least 16 and can enter into a binding agreement. If you access the Service from outside the United States, you are responsible for complying with applicable local laws to the extent they apply to you.
2. Accounts, Subscriptions, Billing, and Renewals
Accounts
You may need an account to access certain features. You agree to provide accurate information and keep your login credentials secure. You are responsible for activity that occurs through your account. Each paid subscription is for one individual user only: one user per seat.
Subscriptions and Payment
Paid subscriptions are purchased and managed through our payment processor, which handles payment processing and provides subscription management tools through your account. The processor’s terms and policies may apply to your purchase and payment relationship.
Our current paid plans and pricing are shown at checkout. Unless otherwise stated, paid plans are billed in advance on a monthly or quarterly basis. We also offer a free tier limited to one ticker, which we may modify or discontinue at any time.
Billing and Renewals
If you purchase a paid subscription, your subscription will automatically renew at the end of each billing period until canceled. You authorize us, through our payment processor, to charge your payment method at checkout and for each renewal at the then-current price. You are responsible for any applicable taxes, except taxes based on our income.
Cancellation
You may cancel your subscription from your account billing settings or as otherwise provided in our subscription management process. Cancellation stops future renewal charges. Your paid access continues until the end of the current paid billing period. Except as stated in our Refund Policy, we do not provide partial-period refunds or credits for unused time.
Refunds and Cancellation
All purchases are final. We do not provide refunds, partial refunds, or credits for any subscription payment, including for unused time, time remaining after you cancel, plan changes, or not using the Service. This applies to both the monthly and the quarterly plan.
Cancel any time. You can cancel from Manage billing in your account. Cancellation stops future renewal charges, and your paid access continues until the end of the billing period you have already paid for. After that period your plan ends and you are not charged again unless you subscribe again.
Failed renewals. If a renewal payment fails, our payment processor may retry the charge a limited number of times over a short period. If the payment still cannot be collected, your subscription is cancelled and paid access ends.
Nothing in this section limits any refund or cancellation right that applicable law gives you and that cannot be waived. Questions about a charge can be sent to [email protected].
Price Changes
We may change subscription prices from time to time. We will provide notice before any price change takes effect for your next renewal, such as by email, website notice, or through your account. If you continue your subscription after the new price applies, you agree to pay the updated price. If you do not agree, cancel before your next renewal.
3. Acceptable Use
You agree to use the Service only for lawful, personal, non-commercial purposes consistent with these Terms.
You agree that you will not:
- use the Service if you are under 16;
- share, sell, resell, rent, or transfer your account or access;
- use more than one user seat under a single paid subscription;
- scrape, crawl, harvest, bulk-download, or use automated tools to collect content, data, analytics, alerts, or outputs from the Service;
- redistribute, republish, sublicense, sell, or share with third parties any market-data-derived content, analytics, exposure maps, flow tape, alerts, setups, outputs, derived datasets, or other Service content, including screenshots, exports, or derived summaries;
- reverse-engineer, decompile, disassemble, or attempt to discover the source code, underlying ideas, algorithms, model logic, methods, or trade secrets of the Service or its models;
- publicly disclose details of our proprietary methods, model logic, data-processing techniques, setup criteria, or other non-public methodology except to the extent we explicitly make it public;
- use the Service or its outputs to build, train, benchmark, or improve a competing product, analytics service, model, or dataset without our prior written permission;
- circumvent access controls, usage limits, or subscription restrictions;
- interfere with the Service’s security, integrity, or performance;
- use the Service to violate any applicable law or regulation; or
- encourage or enable any of the above.
We may monitor use of the Service to enforce these Terms, protect the Service, and prevent abuse.
4. Intellectual Property; Proprietary Methods and Derived Data
The Service, including its design, code, text, educational content, analytics, exposure maps, flow tape, alerts, model-driven setups, paper-trading track record presentation, AI assistant outputs, methods, models, and derived data, is owned by Aether or our licensors and is protected by applicable intellectual-property and proprietary-rights laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own internal, personal use as permitted by these Terms and your subscription level.
Our methods, models, algorithms, data-processing approaches, setup logic, and derived datasets are proprietary. You may not copy, modify, create derivative works from, distribute, or publicly communicate our proprietary methods or derived data except as expressly permitted in writing.
All rights not expressly granted are reserved.
5. NOT FINANCIAL ADVICE
The Service is provided for educational and informational purposes only. Nothing in the Service is investment advice, financial advice, trading advice, legal advice, or tax advice.
We are not a broker-dealer, investment adviser, financial adviser, commodity trading adviser, or exchange. We do not execute trades, handle customer funds, or recommend that you buy, sell, or hold any security or options contract.
No fiduciary, advisory, or client relationship is created by your use of the Service, your purchase of a subscription, or any communication with us.
Options trading involves substantial risk and is not suitable for every investor. You can lose money, including more than your initial investment depending on the strategy and jurisdiction. Any decision you make to trade securities or options is your own responsibility.
Model-driven setups, alerts, analytics, AI assistant responses, and paper-trading results are not recommendations and should not be treated as a signal that any trade is likely to be profitable.
Any “track record,” performance history, or paper-trading record shown in the Service uses modelled fills only. It is hypothetical and educational. No actual capital was risked in that record. Hypothetical or modelled performance has limitations and may not reflect actual market conditions, liquidity, slippage, fees, taxes, or execution results.
We do not guarantee accuracy, completeness, timeliness, profitability, or any particular outcome. Past performance, including paper or modelled performance, does not guarantee future results.
6. Data Accuracy Disclaimer
The Service includes analytics and content derived in part from licensed market data and other third-party sources. We do not control all data sources and cannot guarantee that any data is accurate, complete, timely, or error-free.
Data and analytics may be delayed, incomplete, incorrect, or based on assumptions that change. Alerts, exposure maps, flow tape, analytics, setups, and AI assistant responses may contain errors or omissions.
You should independently verify any information before making any financial decision. Do not rely on the Service as your sole source of information.
7. Availability, Changes, and Modifications
We do not guarantee uninterrupted access to the Service. The Service may be unavailable due to maintenance, outages, third-party failures, internet issues, security events, or other causes.
We may change, suspend, restrict, or discontinue any feature, plan, data feed, model, alert, analytics output, or aspect of the Service at any time, with or without notice, to the extent permitted by law.
We may also change the free tier, including the number of tickers available, at any time.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA, ALERT, MODEL OUTPUT, OR ANALYTIC WILL BE ACCURATE, COMPLETE, OR RELIABLE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AETHER AND ITS OWNER, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOST PROFITS, TRADING LOSSES, LOST DATA, LOST BUSINESS OPPORTUNITIES, OR LOSS OF GOODWILL, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, SUCH AS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY MANDATORY CONSUMER RIGHT THAT CANNOT BE WAIVED.
10. Indemnity
To the extent permitted by applicable law, you agree to defend and indemnify Aether against third-party claims arising out of your misuse of the Service, your breach of these Terms, your violation of applicable law, your trading decisions, or your violation of any third-party right. We reserve the right to participate in the defense of any claim subject to this section.
11. Termination
We may suspend or terminate your access to the Service if you breach these Terms, fail to pay, engage in abusive or illegal conduct, create security or legal risk, or misuse the Service. We may also suspend or terminate access for operational reasons, with notice where practical.
You may stop using the Service and cancel your subscription at any time from your account billing settings. Cancellation stops future charges; access continues until the end of the current paid billing period unless access is terminated earlier for cause.
Sections that by their nature should survive termination will survive, including intellectual-property ownership, acceptable-use restrictions, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.
12. Governing Law
These Terms and your use of the Service are governed by California law, except where mandatory consumer-protection law in your place of residence gives you greater rights. Nothing in these Terms deprives you of any mandatory consumer right available to you under applicable law.
13. Dispute Resolution
Informal Resolution First
If you have a dispute, please contact us first at [email protected] and describe the issue. We will try in good faith to resolve it. You must give us a reasonable opportunity to address the dispute before starting arbitration or a court proceeding, except for claims eligible for small-claims court.
Binding Arbitration
If the dispute is not resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by JAMS or, at the claimant's election, the American Arbitration Association (AAA), in either case under that organization's consumer arbitration rules then in effect, before one arbitrator, seated in California. The arbitration will be conducted in English and will be on an individual basis, not on a class or representative basis. The arbitrator may be selected by videoconference or in person as allowed by the applicable rules. If the selected provider is unavailable, the parties will select a comparable provider or ask a court to appoint one.
Small-Claims Carve-Out
Either party may bring an eligible claim in small-claims court instead of arbitration if the claim qualifies for small-claims court.
Class-Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND AETHER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. TO THE EXTENT PERMITTED, THERE WILL BE NO RIGHT TO CONSOLIDATE CLAIMS OR TO HAVE CLAIMS ARBITRATED OR RESOLVED ON A CLASS-WIDE BASIS.
If any part of this dispute-resolution section is found unenforceable as applied to a particular claim or remedy, the remainder of this section remains in effect.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service, by email, through your account, or by other reasonable means before the changes take effect. Your continued use of the Service after the updated Terms take effect means you accept the updated Terms. If you do not agree, stop using the Service and cancel your subscription.
